Terms of Service

These Terms govern your relationship with the operator of the Gather service, referred to in these Terms as “Gather,” “we,” or “us.” By creating an account, accepting an invitation, or using Gather, you agree to these Terms and the Privacy Policy. If you do not agree, do not use Gather.

1. Eligibility and United States availability

You must be at least 18 years old and located in the United States to use Gather. You represent that you meet these requirements, may legally agree to these Terms, and will provide accurate account information.

2. Your account

Keep your credentials confidential and use accurate information. You are responsible for activity under your account. Contact [email protected] promptly if you suspect unauthorized access. You may not sell, transfer, or share access to your account.

3. Acceptable use

You may not use Gather to:

  • Violate law or another person’s privacy, intellectual-property, publicity, or other rights;
  • Harass, threaten, exploit, discriminate against, impersonate, or endanger another person;
  • Post illegal, deceptive, hateful, sexually exploitative, or malicious content;
  • Spam, scam, distribute malware, or send unauthorized bulk messages;
  • Probe, overload, disrupt, reverse engineer, bypass controls, or gain unauthorized access to Gather or related systems;
  • Scrape or use automated access except through a method Gather expressly authorizes; or
  • Use Gather or its output to make high-impact decisions about another person without appropriate independent review.

4. Your content

You retain ownership of content you create. You grant Gather a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, display, and adapt that content only as reasonably needed to operate, secure, and improve Gather and provide the sharing choices you make. You represent that you have the rights and permissions needed to submit the content. Deleting content or an account may not remove copies already received by other users or records Gather must retain as described in the Privacy Policy.

5. Events and interactions between users

Users—not Gather—create and control events, invitations, guest lists, content, and arrangements with one another. Gather does not supervise events, guarantee another user’s identity or conduct, or assume responsibility for transportation, venues, food, safety, accessibility, legality, or other user arrangements. Use appropriate judgment when meeting or sharing information with others.

6. Shared expenses and external payment links

Shared-expense tools record amounts among users. Any settlement through Venmo, PayPal, Cash App, cash, or another service is a transaction between users and is governed by that provider’s terms. Gather does not hold, transfer, guarantee, or collect those user-to-user funds and is not a party to the underlying arrangement.

7. Gather subscriptions and Gems

Gather may offer optional subscriptions or digital credits called Gems. The price, billing period, included features, and material purchase terms will be shown before checkout. Payments are processed by Stripe. Paid subscriptions renew automatically for the disclosed billing period until canceled. You may cancel through the available billing-management flow; cancellation stops future renewal and does not ordinarily reverse a charge already completed, except where required by law or expressly stated at purchase.

Gems are limited, revocable licenses to use eligible Gather features. They are not money, stored value, property, or transferable between users; have no cash value; and cannot be redeemed for cash except where required by law. We may correct balances affected by fraud, error, reversal, or unauthorized activity. Paid features may change or be discontinued, subject to applicable law.

8. AI-assisted and third-party services

AI-generated suggestions may be incomplete, inaccurate, or unsuitable. Review them before relying on them, especially for safety, health, legal, financial, or other important decisions. Gather may link to or integrate services operated by others; their terms and privacy practices apply to their services, and Gather is not responsible for them.

9. Moderation and enforcement

We may investigate reports; remove or restrict content; limit features; and suspend or terminate accounts when we reasonably believe these Terms were violated or action is needed to protect users, Gather, or others. We are not obligated to monitor all activity and cannot guarantee that every report will result in action.

10. Beta service and changes

Gather is currently a controlled beta. Features may be incomplete, changed, interrupted, or removed. We may impose usage limits or modify eligibility while the service is being tested. We will provide notice of material changes when required.

11. Account deletion and termination

You may request account deletion through Settings, subject to the stated grace period and restrictions needed to address hosted events, unsettled shared expenses, legal obligations, or the rights of others. We may suspend or terminate access for violations, risk, legal requirements, or discontinuation of the service.

12. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GATHER IS PROVIDED “AS IS” AND “AS AVAILABLE.” GATHER DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT GATHER OR USER CONTENT WILL BE ACCURATE, SECURE, AVAILABLE, OR ERROR-FREE. Some jurisdictions do not allow certain disclaimers, so portions of this section may not apply to you.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GATHER AND ITS OPERATOR, CONTRIBUTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR OPPORTUNITIES ARISING FROM OR RELATED TO GATHER. Nothing in these Terms limits liability that cannot legally be limited.

14. Governing law

California law governs these Terms, without regard to conflict-of-law principles, except to the extent another law must apply. Any dispute may be brought in a court with lawful jurisdiction. These Terms do not waive any consumer protection that cannot legally be waived.

15. Changes to these Terms

We may update these Terms as Gather changes. We will update the effective date and provide additional notice when required. If you continue using Gather after updated Terms take effect, you agree to the revised Terms.
